Election dispute is the climax of the election process. The legitimacy of the election process depends in part on the objectivity and impartiality of dispute resolution mechanisms. This objectivity and impartiality is key to building public confidence in democratic institutions and in the election process. It is only when citizens view the election process as legitimate and sound that they will participate in it. One of the on-going challenges for emerging and established democracies is to master the election process and ensure that any dispute challenging “election results” is resolved in a timely, fair and effective manner.
